These Terms and Conditions govern the provision of rubbish removal and waste collection services by Rubbish Removal South Kensington to domestic and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not place a booking or use our services.
These terms apply to all services we provide, including but not limited to household waste clearance, office and commercial waste collection, bulky item removal, garden waste clearance, and related load-and-go rubbish removal services within our operational area in and around South Kensington.
In these Terms and Conditions, the following definitions apply:
Customer means any individual, company or organisation that requests or uses our rubbish removal or waste collection services.
Service means any rubbish removal, waste collection, clearance, loading, transportation, or associated activity provided by us.
Waste means any items, materials, rubbish, junk, or refuse that the Customer asks us to remove, subject to applicable waste regulations and restrictions.
We, us, our means the provider of the rubbish removal and waste collection services trading as Rubbish Removal South Kensington.
Booking means an agreed request for services, whether made by telephone, email, online form, or any other communication method accepted by us.
We primarily operate in South Kensington and surrounding areas. Acceptance of a booking is subject to our confirmation that the address is within a serviceable location and that we have capacity on the requested date and time.
Service availability is subject to staff, vehicle, and equipment availability, weather conditions, access constraints, and any restrictions imposed by local regulations or third parties such as building management or local authorities.
4.1 Booking Requests
Customers may request a booking by contacting us via telephone, email, or any booking system we may operate from time to time. When making a booking request, the Customer must provide accurate details, including the service address, type and approximate volume of waste, access information, preferred date and time, and any relevant restrictions such as parking limitations or building rules.
4.2 Quotes and Estimates
Any quote or price estimate provided before arrival is based on the information supplied by the Customer and is not final until the waste has been inspected on site. If the actual volume, weight, or nature of the waste differs from what was described, we may adjust the quoted price or decline part or all of the job. We will notify the Customer of any changes before commencing work.
4.3 Booking Confirmation
A booking is only confirmed once we have accepted the request and provided a confirmation by email, text, or other agreed method. We reserve the right to refuse or cancel a booking where we reasonably consider the work to be unsafe, impractical, unlawful, or in breach of these terms.
The Customer is responsible for ensuring that we have safe, reasonable, and lawful access to the property and to the waste to be removed at the agreed time. This includes arranging any necessary permissions from property owners, landlords, building management, neighbours, or local authorities.
Parking and access charges, including congestion charges, tolls, or car park fees incurred while performing the service may be added to the final invoice where applicable. The Customer must inform us in advance of any access limitations, restricted parking, or time-limited loading areas.
If we are unable to carry out the service due to lack of access, incorrect information, or failure by the Customer to arrange necessary permissions, we may charge a call-out or abortive fee to cover our costs.
6.1 Acceptable Waste
We are licensed to collect and transport general household and commercial waste, including mixed rubbish, furniture, appliances, garden waste, and office items, subject to applicable weight and volume limits. All waste collection is carried out in accordance with UK waste management legislation and duty of care requirements.
6.2 Prohibited and Restricted Waste
We cannot collect certain hazardous or specialist waste unless explicitly agreed in writing in advance and arranged under the correct regulatory framework. Prohibited or restricted waste includes, but is not limited to, asbestos, clinical or medical waste, chemicals, solvents, fuels, pressurised containers, gas bottles, radioactive materials, and certain electrical or electronic equipment that requires special handling.
If such items are discovered during the service and have not been declared, we may refuse to collect them, adjust the price to account for specialist handling, or cancel the service in whole or in part. The Customer is responsible for ensuring that waste presented for collection complies with applicable regulations and our stated requirements.
6.3 Waste Ownership and Disposal
By presenting waste for collection and paying for the service, the Customer confirms that they have the lawful right to dispose of the items. Ownership of the waste transfers to us at the point of loading, subject to these terms and applicable law. We will transport and dispose of or recycle waste through authorised facilities in compliance with relevant environmental regulations and licensing obligations.
7.1 Pricing Structure
Our charges are typically based on the volume and type of waste collected, the labour involved, and any additional factors such as difficult access, heavy items, or special handling. Prices may also include reasonable charges for parking, congestion zones, tolls, or other third-party fees directly associated with providing the service.
7.2 Payment Terms
Unless otherwise agreed, payment is due on completion of the service. We may accept payment by cash, card, bank transfer, or other methods notified to the Customer. For commercial customers, different payment terms may be agreed in writing, such as invoice payment within a specified number of days.
7.3 Late Payment
If payment is not received on the due date, we reserve the right to charge interest and reasonable recovery costs in line with applicable UK law. We may also suspend or refuse further services until outstanding amounts are paid in full.
8.1 Customer Cancellations
The Customer may cancel or reschedule a booking by contacting us as soon as reasonably possible. We may apply a cancellation charge if insufficient notice is given, particularly where a team and vehicle have already been dispatched or where we are unable to fill the slot with another booking.
We will notify the Customer at the time of booking of any specific cancellation notice periods or charges that apply. Where no specific terms have been stated, we will act reasonably and proportionately in applying any cancellation or call-out fees.
8.2 Our Right to Cancel or Reschedule
We may cancel or reschedule a booking due to reasons beyond our control, such as severe weather, vehicle breakdown, staff illness, access or safety issues, or compliance with law or regulatory guidance. In such cases, we will endeavour to notify the Customer as soon as possible and offer a new appointment where practicable. We will not be liable for any indirect or consequential loss resulting from such cancellation or delay.
8.3 Delays
While we aim to arrive within agreed time windows, arrival times are estimates only and may be affected by traffic, access, or unforeseen circumstances. The Customer should allow reasonable flexibility. We will make reasonable efforts to keep the Customer informed of significant delays.
The Customer should ensure that waste is ready for collection at the agreed time and that the work area is reasonably clear and safe. Where possible, items should be grouped together to facilitate efficient loading. If we are required to dismantle, disconnect, or move items from inside the property, additional labour charges may apply.
The Customer must not ask our staff to carry out any task that is unsafe, unlawful, or outside the agreed scope of the rubbish removal service. We reserve the right to refuse any request that we reasonably believe would pose a risk to health, safety, property, or compliance with regulations.
10.1 Duty of Care
We will exercise reasonable care and skill when providing our services. Our teams will take sensible precautions to avoid damage to property while removing and carrying waste through buildings and communal areas.
10.2 Limitation of Liability
To the fullest extent permitted by law, our total liability to the Customer arising out of or in connection with the provision of the services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the service giving rise to the claim.
We will not be liable for any loss of profits, loss of business, loss of opportunity, or any indirect or consequential loss. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
10.3 Exclusions
We are not responsible for pre-existing damage to property or items, for hidden defects, or for damage occurring because items are inherently unstable, weak, or fragile. The Customer should inform us of any particularly delicate surfaces, fixtures, or items that could be affected during removal operations.
If the Customer is dissatisfied with any aspect of the service, they should contact us promptly with full details so that we may investigate and seek to resolve the issue. We may request supporting information or evidence, such as photographs or receipts, in order to assess any claim.
We aim to resolve complaints fairly and within a reasonable timeframe. If a dispute cannot be resolved directly, the parties may consider using alternative dispute resolution methods where appropriate, without affecting any statutory rights.
We collect and use personal data such as names, contact details, service addresses, and payment information for the purpose of providing rubbish removal and waste collection services, handling bookings, and managing customer relationships. We handle personal data in accordance with applicable UK data protection laws.
We will not sell personal data to third parties. We may share necessary information with service partners, payment processors, or legal and regulatory authorities where required for the performance of our services or to comply with legal obligations.
We may update or revise these Terms and Conditions from time to time to reflect changes in law, regulation, or our business practices. The version in force at the time of a booking will apply to that particular service. It is the Customer's responsibility to review the current terms before placing a booking.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, their subject matter, or their formation, whether in contract, tort, or otherwise.
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision will be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will continue in full force and effect.
No waiver by us of any breach of these terms shall be considered a waiver of any subsequent breach. No third party shall have any rights under these Terms and Conditions under the Contracts Rights of Third Parties Act 1999 or otherwise.
These Terms and Conditions represent the entire agreement between the Customer and Rubbish Removal South Kensington in relation to the provision of rubbish removal and waste collection services, and supersede any prior understandings or agreements, whether written or oral.
We will take full care of picking up your waste and rubbish and then correctly disposing of it either by taking it to a tip that meets with local regulations or by recycling it, which is what we prefer to do whenever we can.
